Terms of use

This English version is provided for your convenience. In case of any discrepancy, the German version is legally binding.

1. Scope

These terms of use apply to the use of Funklog (hereinafter “service”), operated by Marco Kälz.

2. Services

The service provides an online logbook for amateur radio, CB radio, PMR446, Freenet, LoRa and internet radio with callsign lookup, QSL card printing, import/export and optional sync with external online logbooks, as well as community functions (forum with polls, flea market, photo gallery, member profiles and map, messages, member chat, QRV spots, calendar, directories). Use is free of charge. There is no entitlement to permanent availability or to particular functions; maintenance and changes are reserved.

3. Registration

(1) Registration is only permitted for persons aged 16 and over. Each person may only create one account.
(2) The information provided on registration must be true. Access data must be kept secret.
(3) Depending on the setting, the account is activated automatically once the email address is confirmed, or after review by the team. The operator may reject registrations without giving reasons.
(4) Anyone who has been excluded from use (section 4b) may not register again without the operator's consent – not even with other data or via third parties.

4. Obligations of users

(1) Only radio contacts actually made or heard and the details required for them may be recorded.
(2) Data of contact partners may only be used for keeping the logbook and exchanging QSL cards.
(3) Prohibited in particular are: unlawful content, insults and harassment of other members, uploading images without the necessary rights, automated mass queries of the callsign search and attempts to impair the security of the service.
(4) For uploaded images (e.g. QSL motifs, profile photos, ad photos, gallery photos) users confirm that they hold the necessary rights of use.

4a. Services of other providers

(1) At the request of users, the service can work together with offerings of third parties (e.g. eQSL.cc, ARRL LoTW, QRZ.com, HamQTH.com, RadioID.net, callsign list of the Bundesnetzagentur). The operator has no business relationship with these providers; trademarks and names belong to their respective owners.
(2) Users only store their own credentials and use the services in accordance with their terms of use (e.g. QRZ.com XML lookups only with their own subscription). They are responsible for their accounts themselves.
(3) The operator only uses these services on behalf of the respective user, to a reasonable extent (caching, limits) and can switch off individual services at any time, in particular at the request of a provider. There is no entitlement to a particular connection; the operator assumes no liability for the availability and accuracy of third-party data.

4b. Moderation, blocking and exclusion

(1) In the event of violations of these terms or of applicable law, the team may – graded by severity and repetition – remove content, warn the member, mute them (read yes, write no; temporary or indefinite), lock the account and exclude the member from registering again. In the event of serious violations (e.g. criminal content, threats, spam, attacks on the service), immediate locking without prior warning is possible.
(2) The member is informed of the measure and its reason by email. They can raise objections within four weeks (via “Help & support” or by email to info@funktech.de); the team reviews them and communicates the result.
(3) It is prohibited to circumvent a mute, lock or exclusion, in particular by means of further accounts, modified email addresses or third-party data. Such accounts may be locked without notice.
(4) Members can block other members for themselves and mark messages as spam; this does not replace reporting violations to the team.

4c. Chat, chat bot and rooms

(1) The same rules apply in the chat as in the rest of the service. An automatic moderator (“chat bot”) checks messages before publication. If it detects an insult, threat, hate speech or spam, the message is held back; repeated violations lead to a temporary chat mute (10 minutes, 1 hour, 24 hours). The bot can be wrong – moderation reviews held messages and releases false alarms.
(2) The team can create rooms and make access conditional (e.g. an amateur radio callsign from the Bundesnetzagentur list) or admit or exclude individual members. There is no entitlement to access a particular room; requests are possible.
(3) QRV spots may only be posted for actual radio operation, without addresses and without advertising.

5. User data

Logbook data remains the property of the users. It can be exported at any time in ADIF or CSV format. The operator uses it exclusively to provide the service. Details are set out in the privacy policy.

6. Data backup

The operator backs up the data with reasonable care. Users are advised to export their logbook regularly.

7. Liability

(1) The operator is liable without limitation for intent and gross negligence and for injury to life, body or health.
(2) In the event of a slightly negligent breach of essential contractual obligations, liability is limited to the foreseeable damage typical for the contract. Otherwise, liability for slight negligence is excluded.
(3) No guarantee is given for the accuracy of data from external sources (Bundesnetzagentur, group lists, online logbooks).

8. Termination and blocking

(1) Users can delete their account at any time under “My account”.
(2) The operator can terminate the contract of use with two weeks' notice. The right to terminate for good cause and the measures under section 4b remain unaffected.
(3) When the account is deleted, the data is removed as described in the privacy policy. A block list entry may remain for the specified duration.

9. Changes

Registered users will be informed of changes to these terms by email at least two weeks before they take effect. If users do not object within this period, the changes are deemed accepted; this consequence is pointed out in the notification.

10. Final provisions

The law of the Federal Republic of Germany applies. For consumers, this choice of law only applies insofar as it does not deprive them of mandatory protective provisions of the state of their habitual residence. Should individual provisions be invalid, the validity of the remaining provisions remains unaffected.
